Terms of Service:
Please read through the Privacy Policy and Terms of Use.  In using this website, you agree to have read and agreed to the below.

TERMS & CONDITIONS
These are the terms and conditions which apply to your use of the VibeCo Cycle Website (the “Website”) and the VibeCo Cycle Mobile Application (the “App”), and the purchase of Goods and Services from us.  Please read these Conditions carefully before using this Website, the App, or purchasing any Goods or Services from us. If you do not agree to these Conditions, you must not use this Website or our App.

CREDITS
To book a Class, your account must include at least one Credit. One Credit entitles you to attend one Class. You can purchase Credits via our Website or App. Multiple Credits can also be purchased as packages at discounted rates. Price details for Credits are available on our Website or App and shall be determined by VibeCo Cycle. You should be aware that classes and credits expire, and future prices are subject to change. Subject to any statutory right of cancellation, payments for Credits are non-refundable unless otherwise stated in these Conditions. For credit package extension requests, please call the studio, speak with an employee in person, or email info@vibecocyclestudio.com. Please be aware we cannot guarantee your request for package extensions but are happy to discuss in greater detail.

MEMBERSHIPS
Your first-month fee is due upon execution of this Agreement. Thereafter, monthly fees are due on the same day of each subsequent month. Fees must be paid automatically by an electronic fund transfer (“EFT”) from a checking account, debit card, or credit card. By providing your checking account, debit card, or credit card information You are consenting to VibeCo Cycle automatically withdrawing your fees as they come due each month. Your fee shall be based on the specific membership. The current fees for these memberships are set forth on our Website and App. VibeCo Cycle reserves the right to adjust its membership fees at any time during the term of this Agreement. 

GIFT CARDS
Gift cards are available for purchase in the studio and on our website/app. E-Gift Cards can be purchased on our website/app and will be sent via email to the recipient. If you would like to purchase a physical Gift Card, please visit us in the studio or give us a call. PLEASE NOTE: All Gift Cards hold the same expiration dates as our class credits and are stated at checkout.

CANCELLATION POLICY
I
n order to cancel a reservation in a VibeCo Cycle class and return it to your account, you must cancel no later than 8 hours before the start of class. Once your reservation is canceled, the class will be returned to your account to be used at a future date. If you fail to cancel within our cancellation window, the class is not refunded. Late cancellations result in the loss of Credit for package holders. If you are on an unlimited membership and do not cancel within the cancellation window, you will receive a $10 late cancellation fee. If you do not cancel within the cancellation window and fail to notify the studio or late-cancel, you will receive a $15 no-show fee. For any grace cancellation requests, please call the studio, speak with someone in person, or email info@vibecocyclestudio.com. Please be aware we cannot guarantee your request for a grace cancellation but are happy to discuss in greater detail.

You can cancel your reservation in the following ways:

  1. Log into your account on the Website or the App, and, next to the class you wish to cancel, press "unreserve".

WAITLIST: When you join the waitlist, one Credit will be deducted from your account. If you join the waitlist and a space becomes available, you will be automatically added to the Class. You will be notified by e-mail if you are automatically added to a Class.

 If you join a waitlist but no longer wish to attend the Class, you should cancel the booking via our Website or App as soon as possible. If you are added to a Class you may cancel up to 8 hours before the start of class and receive a refund of your Credit but you will not be refunded if you cancel after the 8 hour cancellation window. If you join the waitlist and a place on the fully booked Class does not become available by the start of Class, the Credit debited from your account to join the waitlist will be returned to your series. If we cancel a class, your Credit will be returned to your series.

FOR CLIENTS RUNNING LATE: We ask that you call the studio to let us know you are on the way. If you notify the studio, we will hold a reservation until the class begins, though we cannot guarantee you will be given the bike you signed up for in the particular class. If you do not notify the studio that you are running late, VibeCo Cycle reserves the right to open up your reservation to walk-in riders. We encourage you to arrive on time, but, if you have already notified the studio that you are running late, we will allow a 5 minute grace period after the start of class. 

FOR RIDERS LEAVING EARLY: If you're planning on leaving early, we kindly request that you tell the instructor ahead of time.

MERCHANDISE RETURN
If you change your mind about any Goods purchased from us, you may return them to our studio within 7 days (Unless stated otherwise by VibeCo Cycle during promotional periods and/or Holidays) and we will give you a full refund provided that the Goods are unused and are not damaged. This does not affect your statutory rights as a consumer.

LOST ARTICLES
VibeCo Cycle assumes no responsibility for lost or stolen articles. Lost and found articles not claimed after 30 days will be donated to charity or thrown away.

CODE OF CONDUCT
VibeCo Cycle is committed to the health, safety, and welfare of all of its members and staff and will not tolerate unreasonably, threatening, obscene, harassing, indecent, or illegal behavior. Engaging in such activity shall be grounds for immediate termination of this Agreement.

DAMAGES
VibeCo Cycle client shall pay for any damages to VibeCo Cycle property or equipment which results from his/her willful or negligent conduct.

ACCEPTANCE OF TERMS
By using the Website or App, purchasing a VibeCo Cycle class or membership offerings, registering for a VibeCo Cycle class, booking a bike, purchasing merchandise, and/or using or attending a VibeCo Cycle class, you signify your acceptance of the Terms. If you do not agree to this, please refrain from using the Website or App, purchasing a VibeCo Cycle class or membership offerings, registering for a VibeCo Cycle class, booking a bike, purchasing merchandise, and/or using or attending a VibeCo Cycle class.

Occasional changes may be made to this document to reflect changes in VibeCo Cycle’s policies. The terms may be revised at any time by updating this posting. By using the Website or App, by buying VibeCo Cycle Classes, registering for classes, booking bikes, buying merchandise, and/or using and attending VibeCo Cycle studio, you agree to be bound by such revisions. Riders and community members are encouraged to check this document  periodically to stay informed of current guidelines.

WAIVER AND RELEASE
Rider’s Waiver / New Rider Waiver. By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment, or any other location or venue where VibeCo Cycle is providing services (individually and/or collectively, the “Classes and Facilities”) of VibeCo Cycle. I hereby acknowledge on behalf of myself, my heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in indoor cycling and exercise equipment in association with the Classes and Facilities. I acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. I also acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death. At all times, I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to me by staff. If in the subjective opinion of the VibeCo staff, I would be at physical risk participating in VibeCo’s Classes, I understand and agree that I may be denied access to the Classes and Facilities until I furnish VibeCo Cycle with an opinion letter from my medical doctor, at my sole cost and expense, specifically addressing VibeCo concerns and stating that VibeCo concerns are unfounded. In consideration of being allowed to participate in and access the Classes and Facilities, I hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by me in relation to the Classes and Facilities, (2) release, indemnify, and hold harmless VibeCo Cycle, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Classes or use of the Facilities, and (3) represent that I (a) have no medical or physical condition that would prevent me from properly using any of VibeCo Classes and Facilities, (b) do not have a physical or mental condition that would put me in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. I acknowledge that if I have any chronic disabilities or conditions, I am at risk in using VibeeCo Classes and Facilities, and should not be participating in any Classes.

I have read this Assumption of Risk, Waiver, and Release Agreement, fully understand its terms, and understand that I am giving up substantial rights including my right to sue VibeCo Cycle under certain circumstances. The term of this waiver is indefinite.

VALUABLES AND PERSONAL PROPERTY: I acknowledge that I have been urged to avoid bringing valuables into the Facilities and that VibeCo Cycle shall not be liable for the loss of, theft of, or damage to my personal property, including items left in lockers, bathrooms, studios, or anywhere else in the Facilities. I acknowledge that no portion of any fees paid by me is in consideration for the safeguarding of valuables.

PRIVACY POLICY
MLV VENTURES, LLC (“VibeCo Cycle”) takes your privacy seriously. Please read the following to learn more about our privacy policy (the “Privacy Policy”).

This Website, www.vibecocyclestudio.com and the pages contained therein (collectively, the “Website”), is intended to describe and promote VibeCo Cycle’s services. VibeCo Cycle values its customers and their concerns about privacy. To this end, VibeCo Cycle engages  in consistent information practice and uses its best efforts to make clear disclosures regarding those practices. This Privacy Policy  is a part of that effort. 

In general, VibeCo Cycle does not share your personally identifying information with third parties unless you permit it. 

What does this Privacy Policy cover?
This Privacy Policy applies to the collection, use, storage, and disclosure of customer information by VibeCo Cycle. By using our website, you consent to the collection and use of information as outlined in this Privacy Policy. We will clearly disclose any exceptions to the Privacy Policy prior to collecting any information from our users. VibeCo Cycle may decide to modify or amend this Privacy Policy from time to time. When we do, we will post any changes or new language here.

What information does VibeCo Cycle collect and how is it used?

VibeCo Cycle may collect contact information including your name, address, e-mail address, and other personally identifying information when you (i) purchase VibeCo Cycle products or services through the website or (ii) choose to contact VibeCo Cycle via the website, place an order, or request information through our website. Contact information provided in connection with information requests will be used to respond to those requests. Contact information provided when you purchase VibeCo Cycle products or services shall be shared only for the purposes of processing your transaction, including fraud prevention and credit card authorization. VibeCo Cycle may use your contact information to provide you with information regarding future products, promotions, or other news.
